Jim Walsh explains that the standards for Title IX liability for school districts are high. A plaintiff must prove that someone in authority to correct the situation knew about the misconduct and consciously chose not to do anything about it. New regulations state that if any employee of a school district knew of misconduct, that district is on notice and is charged with the duty to act.
